Lisa Blue Baron, a trial attorney at Athea Trial Lawyers, has had a prolific legal career that has made a monumental impact on the industry. She was elected President of the American Association for Justice in 2014 and has written multiple books that attorneys consider required reading including her 2004 book, Blue’s Guide to Jury Selection, the ‘bible’ of jury selection. In 2015, she was inducted into the U.S. Trial Lawyers Hall of Fame. She joins us on the pod to introduce her new book. Jamal Alsaffar of Whitehurst, Harkness, Brees, Cheng, Alsaffar, Higginbotham, and Jacob, PLLC returns to the pod to discuss the most recent developments of the trial for the 2017 Sutherland Springs mass shooting at First Baptist Church in Sutherland Springs, Texas. Tad Thomas and Mike Campbell first talked with Jamal about the case in August 2021, during the case’s liability phase. During this phase of the trial, the federal government was found to be 60% liable for failing to hold the shooter accountable for acts of domestic violence and threats he conducted before the shooting occurred. In Texas, that 60% translates to 100%. Earlier this year, a verdict for $230,000,000 was reached during the damages phase of the trial—an amount the government is fully liable for. Currently, the case is in the appeal phase. In the pod, Jamal discusses what the appeal phase looks like for a massive case of this nature, what the government’s options are and how the case was handled, and some of the implications of the case’s resolution. This case has been groundbreaking in multiple ways due to the way the courts have had to take a long, hard look at gun laws in our nation as well as the ramifications of a shooting of this size. Jamal also discusses the incredible complexities of the trial, which involved 26 instances of wrongful death and 22 injuries. The organizational complexities alone were tremendous. As President for 2022-23, Chris shares exciting developments about the organization, including its rebrand to “The National Civil Justice Institute.” The Institute is largely known for its annual Judge’s Forum, which brings together numerous state appellate court judges to discuss evolving issues in the justice system in a way that allows a balanced and free exchange of ideas. In 2005 Congress enacted the Protection of Lawful Commerce in Arms Act (PLCAA) which gave immunity to gun manufacturers at a time when gun violence in America was skyrocketing. Following the tragic shootings in Sandy Hook the families of victims sought to hold Remington, the maker of the AR-15, accountable for its role in the murders of the 20 first graders and 5 teachers. Attorney Josh Koskoff, of the legendary Koskoff firm started by his grandfather, and his team were able to navigate the immunity issues associated with PLCAA in a case that went to the U.S. Supreme Court and back, survived two bankruptcies, and ultimately resulted in a $73 million settlement. Brian Cuban discusses his story of addiction, eating disorders, and other serious afflictions in his book, The Addicted Lawyer: Tales of the Bar, Booze, Blow, and Redemption, which can be found here. As Brian recounts the traumatic events in his life that correlate to his struggle with addiction, he addresses the challenges he faced as a child and how they continued throughout his life. He highlights how the body keeps the score—when unresolved trauma can persist and lay the groundwork for addiction or other mental health issues to develop. Automated vehicles are the future for travel and shipping on American roadways — but significant questions still exist about how safe those vehicles are for human and commercial use. Tobi Millrood is a partner at the firm Pogust Millrood in suburban Philadelphia, PA, and is also President-elect of the American Association for Justice. Tobi joins Tad and Mike to discuss his upcoming year as President of the American Association for Justice and how he plans to lead the organization, while also maintaining a law practice and directing his caseload. Tobi also shares a very personal story—the loss of his mother, Sylvia, to COVDI-19. Unfortunately, as we’ve often seen in the past few months, Sylvia’s contraction of COVID-19 occurred at a nursing home where 20 other patients died, and dozens fell ill. Tobi detailed the tragic circumstances of his mother’s death in an article he wrote for the New York Times entitled, “Why is Mitch McConnell Protecting Nursing Homes?” In the podcast, Tobi shares his mother’s story and the story of her life, illuminating the person who was tragically lost to an illness she should’ve never been exposed to, had the nursing home taken preventative measures.
